Illumina announces new ruling in its patent litigation against Complete Genomics, Inc.

San Diego, California, USA
November 26, 2012

Illumina, Inc. (NASDAQ:ILMN) announced that Magistrate Judge Elizabeth D. Laporte of the U.S. District Court for the Northern District of California granted Illumina's request to file a motion seeking reconsideration of the Court's October 16, 2012 ruling invalidating certain claims of U.S. Patent No. 6,306,597, which is being asserted by Illumina against Complete Genomics, Inc. Under Judge Laporte's order, Illumina is permitted to file briefing asking the Court to reconsider its earlier ruling invalidating claims 14 and 15 of the '597 patent. Illumina will seek a January 8, 2013 hearing date on the motion for reconsideration.

Jay Flatley, Illumina's President and CEO, stated, "We are very pleased that the Court has agreed to review its earlier decision invalidating certain claims of Illumina's '597 patent. We continue to believe that this patent covers important and novel inventions that Complete Genomics has misappropriated."
